New USCIS Policy on I-539 Untimely Filed Extensions of Stay and Change of Status Requests

On January 24, 2024, U.S. Citizenship and Immigration Services (USCIS) is issued policy guidance in the USCIS Policy Manual to address when USCIS may, in its discretion, excuse untimely filed extensions of stay and change of status requests.

Generally, certain nonimmigrants present in the United States admitted for a specified period of time, or their petitioners, may request an extension of their admission period in order to continue to engage in those activities permitted under the nonimmigrant classification in which they were admitted.1 Also, certain nonimmigrants present in the United States, or their petitioners, may seek to change their status to another nonimmigrant classification if they meet certain requirements.

In general, USCIS does not approve an extension of stay or change of status for a person who failed to maintain the previously accorded status or where such status expired before the filing date of the application or petition. These requests must be filed while a nonimmigrant is still in status,

If certain conditions are met, however, USCIS, in its discretion, may excuse the failure to file before the period of authorized status expired. This guidance, contained in Volume 2 of the Policy Manual, is effective immediately and applies prospectively to applications or petitions filed on or after that date.

The guidance contained in the Policy Manual is controlling and supersedes any related prior guidance on the topic.

Policy Highlights

• Provides that USCIS, in its discretion and under certain conditions, may excuse the failure to timely file extensions of stay and change of status requests if the delay was due to extraordinary circumstances beyond the control of the person.

• Clarifies that extraordinary circumstances may include but are not limited to: where the delay was due to a slowdown or stoppage of work involving a strike, lockout, or other labor dispute; 
or where the primary reason for the late filing is due to a lapse in government funding supporting those adjudications.

Summary of Changes

Affected Section: Volume 2 > Part A > Chapter 4 > Section A, Extension of Stay or Change of Status • Adds a new italicized subsection “Requirements to Timely File a Request to Extend Stay or Change Status.” USCIS may also make other minor technical, stylistic, and conforming changes consistent with this update. Citation Volume 2: Nonimmigrants, Part A, Nonimmigrant Policies and Procedures, Chapter 4, Extension of Stay, Change of Status, and Extension of Petition Validity [2 USCIS-PM A.4]. 

Requirements to Timely File a Request to Extend Stay or Change Status
In general, USCIS does not approve an extension of stay or change of status for a person who failed to maintain the previously accorded status or where such status expired before the filing date of the application or petition.[5] USCIS, in its discretion, may excuse the failure to file before the period of authorized status expired where the requester demonstrates within the extension of stay or change of status request that:
  • The delay was due to extraordinary circumstances beyond the person’s control;
  • The length of the delay was commensurate with the circumstances;
  • The person has not otherwise violated their nonimmigrant status;
  • The person remains a bona fide nonimmigrant; and
  • The person is not the subject of removal proceedings and, in the case of extensions of stay, is also not the subject of deportation proceedings.[6]
In general, subject to its discretion, examples of what USCIS considers extraordinary circumstances beyond the control of the person may include, but are not limited to:
  • Where the person remained in the United States after the expiration of the period of admission due to a slowdown or stoppage of work involving a strike, lockout, or other labor dispute; or
  • Where the primary reason for the late filing is the inability to obtain a certified labor condition application or temporary labor certification due to a lapse in government funding supporting those adjudications.
If USCIS approves an untimely filed application or petition to extend an applicant’s or beneficiary’s stay, the approval is effective as of the date of the expiration of the prior nonimmigrant admission period.[7] When USCIS approves a late filed application for a change of status, the change of status takes effect on the approval date. USCIS considers the applicant or beneficiary of an approved untimely change of status request to have maintained lawful status during the period USCIS excused.[8]

Extension for U4U Uniting for Ukraine Rules

Extension for Certain Ukrainians Paroled into the United States.

Certain Ukrainian nationals and immediate family members were paroled into the United States last year, on a case-by-case basis for urgent humanitarian reasons, during an approximate eight-week period after Russia’s unprovoked invasion of Ukraine and before the Uniting for Ukraine process was available. Such individuals were generally paroled for a period of one year, while participants in Uniting for Ukrainereceived a two-year period of parole.

With hostilities in Ukraine entering their second year, DHS assesses that there remain urgent humanitarian reasons, as well as a significant public benefit, for extending the parole of certain Ukrainians who arrived prior to Uniting for Ukraine. DHS will consider Ukrainian nationals and immediate family members who were paroled, on a case-by-case basis, before Uniting for Ukraine for an extension of the parole period and employment authorization, if applicable.

Specifically, individuals paroled into the United States at a port of entry between February 24, 2022 and April 25, 2022 will be considered for an extension. DHS is in the process of considering these individuals, on a case-by-case basis, for a one-year extension of their period of parole to align with the two-year parole period provided under Uniting for Ukraine. DHS estimates it will take approximately four weeks to consider and vet all the individuals in the group and will review cases based on the date of parole.

If an individual’s parole period is extended, DHS will proactively make available online an updated Form I-94 with the extended parole period. The period of parole will be extended from the current expiration date without a gap. Individuals can retrieve and download an updated Form I-94 as evidence of their extended parole period by visiting CBP’s Form I-94 website.

Those who have their period of parole extended will also be eligible to receive employment authorization for the additional year. Individuals who have Employment Authorization Documents (EADs) based on their parole and whose parole period is extended for an additional year will receive a Form I-797C from USCIS that can be used to demonstrate continued employment authorization through the extended parole period.  The Form I-797C will be mailed to the address on file with USCIS.  If you need to change your address, please change your address online through your existing USCIS online account or using the Form AR-11, Alien’s Change of Address Card, online using the Change of Addresspage.

  • If you do not currently have an EAD but would like to apply for one based on your parole, you may file a Form I-765, Application for Employment Authorization, with USCIS. Ukrainian parolees are exempt from fees for first time applicants.
Ukrainian parolees may pursue multiple immigration pathways at the same time and this process does not impact other benefit requests including those who have applied for Temporary Protected Status (TPS), been granted TPS, or applied for asylum.

However, parole will terminate automatically upon departure from the United States. Individuals with parole who plan to depart the United States and wish to return must first apply for advance parole in order to be considered for reentry into the United States.

​Продление пароля на один год относится только к тем украинцам, которыео въехали в США в феврале, марте и по 25 апреля 2022 года через Мексиканскую границу и получил гуманитарный пароль на один год. Это не относится к тем, кто приехал после 25 апреля по программе Uniting for Ukraine.

Пароль должен быть автоматически продлен еще на один год. Вам ничего не нужно делать. Только  проверять форму i-94 на сайте CBP,

CBP опубликует новые форма 94 с новыми датами. 

Дополнительно до конца апреля 2023 вам придет по почте письмо продляющее разрешение на работу на один год с даты истечения старого (то есть у вас не будет перерыва). Письмо придет по вашему почтовому адресу, который был указан в заявлении на разрешение на работу I-765.. Если вы переехали, срочно подайте форму AR-11 online и сделайте это правильно.

Остальных граждан Украины это не касается - тех кто приехал по туристическим и другим визам, и тех кто посил ПУ   политическое убежище после 25 апреля 2022 на границе с Мексикой, или тех у кого парольт на два года по прошрамме U4U..​

Если у вас нет разрешения на работу, вы можете его подать I-765 в USCIS. Украинцы по гуманитарному паролю не платят за первое заявление.

Пока не совмесм понятно будут ли продлевать пароль тем, кто уже подался на TPS или получил TPS.

По закону украинцы могут использовать несколько путей иммиграции одновременно, и это не влияет на то, подали ли вы на получение временной защиты (TPS), получили статус TPS или подали прошение о предоставлении убежища.

U.S. Citizenship and Immigration Services is extending certain COVID-19-related flexibilities through Jan. 24, 2023, to assist applicants, petitioners, and requestors. Under these flexibilities, USCIS considers a response received within 60 calendar days after the due date set forth in the following requests or notices before taking any action, if the request or notice was issued between March 1, 2020, and Jan. 24, 2023, inclusive:
  • Requests for Evidence;
  • Continuations to Request Evidence (N-14);
  • Notices of Intent to Deny;
  • Notices of Intent to Revoke;
  • Notices of Intent to Rescind;
  • Notices of Intent to Terminate regional centers;
  • Notices of Intent to Withdraw Temporary Protected Status; and

As a reminder, the reproduced signature flexibility announced in March 2020 became permanent policy on July 25, 2022.

In an effort to take the lessons learned from our pandemic posture, USCIS has been evaluating which flexibilities can and should be extended permanently. As a result of this evaluation, the reproduced signature flexibility announced in March, 2020, will become permanent policy on July 25, 2022.

Automatic Employment Authorization Document (EAD) Extension Up to 540 Days

С 4 мая 2022 разрешение на работу считается продленным на 540 дней (вместо 180 дней), если новое заявление подано до срока истечения предыдущего в определенных категориях. Это временное правило действует с 4 мая 2022 по 26 октября 2023.

Effective May 4, 2022, U.S. Citizenship and Immigration Services (USCIS) announced that the Department of Homeland Security (DHS) is temporarily amending existing DHS regulations related to expiring employment authorization and Employment Authorization Documents (EADs) for certain renewal applicants. The prior extension period of up to 180 days will automatically increase to up to 540 days from the expiration date stated on their current EADs.

The up to 540-day automatic EAD extension only applies to those EAD categories currently eligible for the previous up to 180-day automatic extension of employment authorization and EAD validity. USCIS will provide up to 360 days (for a total of up to 540 days) of additional automatic extension time to eligible applicants with a pending EAD renewal application on the temporary rule’s effective date and for 540 days thereafter (that is, from May 4, 2022 to Oct. 26, 2023).

Applicants with pending I-765 renewal applications as of May 4, 2022, will not receive a new receipt notice reflecting the increased EAD automatic extension period. However, Form I-797C notices that refer to a 180-day automatic extension will still meet the regulatory requirements for employment authorization. Therefore, individuals who show Form I-797C notices that refer to a 180-day extension, along with their qualifying EADs, still receive the up to 540-day extension under this rule. 

What does the Temporary Final Rule mean for your employees?
  • If an employee’s automatic extension lapsed prior to May 4, 2022, the employment authorization automatically resumed, and the EAD validity period began on May 4, 2022 and will continue up to 540 days from the expiration of the EAD card.
  • If an employee’s EAD card has expired but the employee still has time remaining in the 180-day extension, they are now able to receive an additional 360 days, for a total of 540 days past their EAD “Card Expires” date.
  • If an employee’s EAD card has not expired yet and the Form I-765 is still pending, then the employee will receive an automatic extension of up to 540 days once their EAD card expires before their Form I-765 is adjudicated.
  • If an employee files an EAD renewal application between May 4, 2022 and Oct. 26, 2023, then the employee’s EAD will automatically be extended up to 540 days if their EAD card expires before their Form I-765 is adjudicated.
Are my employees eligible for the 540-day extension?
To qualify for the extension, the employee must:
  • Fall within the following categories: A03, A05, A07, A08, A10, A17*, A18*, C08, C09, C10, C16, C20, C22, C24, C26*, C31, and A12 or C19. (See below for guidance on A17, A18 and C26)
  • Have timely filed a Form I-765 Application for Employment Authorization, before their current EAD expired.
  • Have an I-797C, Notice of Action for the filed Form I-765 that contains the same category code as their expiring EAD.

EAD extension rule will no longer apply to applications after Oct. 26, 2023, USCIS will return the 180 automatic extension rule.

Categories A17, A18 and C26.

For employees who fall within EAD categories A17 (E spouses), A18 (L-2 spouses) and C26 (H-4 spouses), the extension period cannot exceed the Form I-94 end date. Employees will need to present their expired EAD, their I-797C Notice of Action and Form I-94 to determine the extended expiration date. In these instances, the extension may be greater than 180 days but fewer than the additional 360 days, as the EAD must expire when the Form I-94 ends.

On March 30, 2022, USCIS in response to the COVID-19 pandemic, U.S. Citizenship and Immigration Services is extending again certain flexibilities through July 25, 2022, to assist applicants, petitioners, and requestors. USCIS anticipates this may be the final extension of these flexibilities.

I-751 Petition to Remove Conditions Receipt Validity Extended to 24 Months

Starting September 4, 2021, USCIS is extending the time that receipt notices can be used to show evidence of status from 18 months to 24 months for petitioners who properly file Form I-751, Petition to Remove Conditions on Residence, or Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status.

USCIS made the change from 18 to 24 months to accommodate current processing times for Form I-751 and Form I-829, which have increased over the past year.
Conditional permanent residents who properly file Form I-751 or Form I-829 will receive a receipt notice that can be presented with their Form I-551, Permanent Resident Card (also known as a Green Card), as evidence of continued status for up to 24 months past the expiration date on their Green Card, while their case remains pending with USCIS.
Additionally, USCIS will issue new receipt notices to eligible conditional permanent residents who properly filed their Form I-751 or Form I-829 before Sept. 4 and whose cases are still pending. Those receipt notices will also serve as evidence of continued status for 24 months past the expiration date on their Green Card.

Начиная с 4 сентября 2021, USCIS будет выдавать официальные Receipt Notices, Forms I-797, петиционерам, подавшим петицию I-751 на снятие условностей с грин карты, и продляющие срок действия истекшей грин карты на 24 месяца (до сих пор это было 18 месяцев).
Это нововведение вызвано тем, что сроки рассмотрения петиций замедлились и порой занимают более 2-х лет.
Если ваша петиция была подана до 4 сентября 2021 и все еще на рассмотрении, то вы получите новый Receipt, с новой датой продления на 24 месяца вместо 18 месяцев.

RFE Response Period Extended by Additional 60 Days

  • RFE, Requests for Evidence;
  • Continuations to Request Evidence (N-14);
  • NOID, Notices of Intent to Deny;
  • NOIR, Notices of Intent to Revoke;
  • NOIR, Notices of Intent to Rescind;
  • Notices of Intent to Terminate regional centers; and
  • Motions to Reopen an N-400 Pursuant to 8 CFR 335.5, Receipt of Derogatory Information After Grant.
In addition, USCIS will consider a Form I-290B, Notice of Appeal or Motion, or Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA), if:
  • The form was filed up to 60 calendar days from the issuance of a decision we made; and
  • We made that decision anytime from March 1, 2020, through Sept. 30, 2021
Notice/Request/Decision Issuance Date:
This flexibility applies to the above documents if the issuance date listed on the request, notice or decision is between March 1, 2020, and Sept. 30, 2021, inclusive.
Response Due Date:
USCIS will consider a response to the above requests and notices received within 60 calendar days after the response due date set in the request or notice before taking any action. Additionally, we will consider a Form N-336 or Form I-290B received up to 60 calendar days from the date of the decision before we take any action.

On May 1, 2020, USCIS announced that RFE and NOID, NOIR Response Time extended by 60 days for a period beginning March 1 and ending July 1, 2020.

In response to the coronavirus (COVID-19) pandemic, USCIS is extending the flexibilities it announced on March 30, 2020 to assist applicants and petitioners who are responding to certain:
Requests for Evidence, RFE;
Continuations to Request Evidence (N-14);
Notices of Intent to Deny, NOID;
Notices of Intent to Revoke, NOIR;
Notices of Intent to Rescind and Notices of Intent to Terminate regional investment centers; and
filing date requirements for Form I-290B, Notice of Appeal or Motion.
Notice/Request/Decision Issuance Date
This flexibility applies to the documents listed above if the issuance date listed on the request, notice, or decision is between March 1 and July 1, 2020, inclusive.
Response Due Date
USCIS will consider a response to a request or notice listed above received within 60 calendar days after the response due date set in the request or notice before taking action. USCIS will consider a Form I-290B received up to 60 calendar days from the date of the decision before it takes any action.

New Policy: No Deference to Prior Determinations of Eligibility in Petitions for Extension of Nonimmigrant Status

On October 23, 2017, another long-standing USCIS adjudication policy was reversed. When filing for an extension of the non-immigrant status, for example, H-1B work visa, you should not take for granted any prior approvals. An applicant has to prove his/her eligibility again when applying for an extension of the same status, even if status was approved before. USCIS will no longer defer to prior approvals.

October 23, 2017 Policy Memorandum "Rescission of Guidance Regarding Deference to Prior Determinations of Eligibility in the Adjudication of Petitions for Extension of Nonimmigrant Status" is available at USCIS webportal.

As a result, USCIS made it more difficult for companies to renew H-1B visas for foreign professionals (workers) who work in specialty occupations. Previously, when it was time to renew an H-1B employee’s status, the USCIS gave deference to past H-1B approval decisions. This enabled H-1B visa holders to obtain extensions in a fast and straightforward manner. USCIS recently rescinded (canceled) their old policy memorandum, and now H-1B visa holders who apply for extensions must again prove eligibility as though they are seeking H-1B visas for the first time.

This policy change will impose greater uncertainty, loss of foreign talent (who may choose to migrate to Canada instead), higher costs and delays to companies who rely on foreign talent.

USCIS is directing officers to use the same amount of scrutiny for initial and extension requests, and indicating that the new guidance applies to a variety of employment visas, not just H-1B.

It is expected that employers will be receiving many detailed Requests for Evidence (“RFE”) when H-1B extension requests are filed. These RFEs will increase the administrative and legal burden on employers seeking H-1B visas, and increase the costs.

Effective October 1, 2017, USCIS also imposed a new rule requiring in-person interviews with all employment-based immigrant visa applicants, including spouses and children, which will burden local USCIS offices and increase wait time for all green card categories waiting for an adjustment of status interview.

H-1B visas are valid for a total of six years and are usually issued in three-year increments. To prepare for the new renewal process, H-1B employers should initiate the renewal process far enough in advance to secure an extension before an H-1B employee’s status expires.

Effect of DUI, DWI and other alcohol related crimes, arrests, convictions on admissibility to USA

Alcohol-related crimes, charges, convictions are a health-related ground of inadmissibility to the United States.

USCIS, DHS, ICE, Department of State and other immigration authorities are now following the new policy regarding the individuals who have alcohol-related charges, arrests or offenses. Immigrants should keep in mind the consequences of having even one alcohol related criminal charge or offense, which means that USCIS possibly can find them ineligible for an extension of status, change of status, adjustment of status request.

In some cases (not always) it could be possible to leave the U.S.A. and apply for a visa at the U.S. Consulate abroad. However, U.S. Consulates abroad can require applicants to be evaluated by a designated panel physician who will evaluate whether the visa applicant has a physical or mental disorder associated with alcohol use that may pose a threat to the property, safety or welfare of others in the United States.

It should be noted that the U.S. Consulates are now often revoking already issued and valid visas of affected foreign nationals when they receive a law enforcement report of a DUI-related arrest or conviction regardless of whether individuals are in the United States or abroad at the time. A person can receive a phone call or email asking him or her to come to the U.S. Consulate with a passport (no explanations given), so a visa can be physically revoked (cancelled). Most people are unaware that their visas are revoked until they try to return to the United States after travel abroad.  ​Some people with alcohol-related charges receive letters from the U.S. Department of State notifying them of their visa revocation. 

Because these negative consequences are result of the health-related ground of inadmissibility, it means that no conviction is necessary (arrest and charged are enough). 

Until recently, the only affected groups of people were the visa holders with a single alcohol-related arrest or conviction within the last five years, or two or more alcohol-related arrests or convictions.

Under the current policy, it only takes a single alcohol-related charge to trigger action by U.S. authorities. USCIS is now identifying alcohol-related offenses and denying requests for an extension of status in any visa classification.

Until recently and before this policy change, U.S. Consulates only referred visa holders to a panel physician for evaluation when a new visa application was made. Now, U.S. Consulates are responding to law enforcement reports proactively by revoking the already approved and issued visas of anyone who has an alcohol-related charge even in situations where an individual hasn’t made a new visa application.

If USCIS denied an application for extension or change of status, the applicant will have to leave the country and apply for a visa at a U.S. consulate abroad, in his home country. “Every nonimmigrant alien who applies for admission to, or an extension of stay in, the United States must establish that he or she is ​admissible to the United States, or that any ground of inadmissibility has been waived.” In other words, it is an applicant's burden to prove that he/she is not inadmissible. 

An alcohol-related charge is a health ground of inadmissibility, which means that a conviction is not required and charges alone can trigger inadmissibility. Visa holders affected by this rule are not removable (not deportable on this ground) from the United States.

If a visa is denied, can a visa applicant file an appeal of denial of a Visa Application at the U.S. Consulate abroad?  No, you can't appeal a visa denial. There is no appeal process to challenge a consular officer’s decision to deny a visa application. The doctrine of "nonreviewability of consular decisions" was affirmed by the U.S. Supreme Court in 2015 in the case Kerry v. Din .

Another important moment to keep in mind is that neither the visa applicant nor the attorney can review the panel physician’s medical report.

What else can be done? People can ask for an Advisory Opinion from the Department of State’s Visa Office. Also, visa applicants can dispute the findings of the panel physician by asking the consular officer to request an Advisory Opinion from the U.S. Centers for Disease Control and Prevention (CDC), which the consular officer can refuse to do without recourse. Both of these options take a lot of time. As a result, most of the nonimmigrant visa applicants have to obtain a nonimmigrant waiver of inadmissibility through the DHS, which could take six months or longer to process, and during this time the visa applicant has to wait abroad. Approval of any immigrant or nonimmigrant visa waiver is not guaranteed.

During October 19, 2017 meeting, AILA asked the US Department of State Liaison Committee and the Visa Office the following question:

"AILA has received reports of visa holders whose visas were prudentially revoked for DUI arrests while they are in the United States being charged by ICE as removable under INA §237(a)(1)(B), for being physically present in the United States with a revoked nonimmigrant visa. Based on our previous conversations, it is our understanding that a prudential revocation only becomes effective once the alien departs the United States. Has VO discussed this issue with DHS? If prudential revocations are now leading to the initiation of removal proceedings, would VO be willing to revisit the issue to ensure that the prudential revocation only precludes future travel to the United States?"

DoS answer: "We’ve discussed this with ICE, and there has not been a policy change."

USCIS Reissues I-797 Receipts for I-765 Application for a Work Permit Filed Between July 21 2016 and January 16 2017

On February 24, 2017 USCIS announced that they are re-issuing and mailing new receipts to applicants for a work permit EAD. No need to worry if you receive a second receipt, USCIS Form I-797. It's to notify you that your old expired work permit or EAD was automatically extended for additional 180 days if you filed I-765 while your previous EAD was still valid. This applies to applications filed after July 21, 2016 and before January 16, 2017. Applications filed after January 17, 2017 already receive a new form of I-797 extending EAD for 180 days.

USCIS Release Date: February 24, 2017

Starting February 16, 2017, USCIS began reissuing receipt notices (Form I-797) to individuals who applied to renew their Employment Authorization Document (EAD) between July 21, 2016 and January 16, 2017, and whose applications remain pending in the following categories: 
  • (a)(3) Refugee
  • (a)(5) Asylee
  • (a)(7) N-8 or N-9
  • (a)(8) Citizen of Micronesia, Marshall Islands, or Palau
  • (a)(10) Withholding of deportation or removal granted
  • (c)(8) Asylum application pending
  • (c)(9) Pending adjustment of status under section 245 of the Immigration and Nationality Act
  • (c)(10) Suspension of deportation applicants (filed before April 1, 1997), cancellation of removal applicants, and special rule cancellation of removal applicants under NACARA
  • (c)(16) Creation of record (Adjustment based on continuous residence since January 1, 1972)
  • (c)(20) Section 210 Legalization (pending Form I-700)
  • (c)(22) Section 245A Legalization (pending Form I-687)
  • (c)(24) LIFE Legalization
  • (c)(31) VAWA self-petitioners
On January 17, 2017, USCIS began automatically extending expiring EADs for up to 180 days for renewal applicants in these categories. However, some of the receipt notices that USCIS sent out before that date did not contain the applicant’s EAD eligibility category. Therefore, the reissued receipt notices will contain: 
  • The applicant’s EAD eligibility category;
  • The receipt date, which is the date USCIS received the EAD renewal application and which employers must use to determine whether the automatic EAD extension applies;
  • The notice date, which is the date USCIS reissued the receipt notice; and
  • New information about the 180-day EAD extension.  
Applicants may present the reissued receipt notice with their expired EAD to their employer as a List A document for the Form I-9, Employment Eligibility Verification, to show that they are authorized for employment.      
Applicants with an EAD based on Temporary Protected Status (TPS) who filed their EAD renewal applications before January 17, 2017, already received a 6-month extension through the Federal Register notice that extended their country’s TPS designation. Therefore, these applicants will not receive a reissued receipt notice. Please visit the Temporary Protected Status page for current information on each TPS designation. All renewal applicants who file Form I-765 applications on or after January 17, 2017, including TPS renewal applicants, will be receiving Form I-797 receipt notices that contain eligibility category information and information about the 180-day EAD extension.

24 февраля 2017 г USCIS иммиграционная служба США опубликовала пресс релиз для публики о том, что после 16 февраля 2017 они начали высылать новые уведомления I-797 о принятии заявление на продление разрешения на работу, форма I-765. Нет необходимости пугаться и звонить в иммиграционую службу. Это делается потому, что по новым правилам, если вы подали заявление на продление разрешения на работу до истечения срока действия (после 21 июля 2016 и до 16 января 2017), то его автоматически продлили на 180 дней. Вы можете показать это уведомление вашему работодателю, когда вы оформляетесь на работу как доказательство того, что вам разрешено работать в США в течние следующих 180 дней пока вы ждете новое разрешение на работу. Оно имеет такую же юридическую силу как само разрешение на работу.
