NEW How to Get ADIT Stamp or Evidence of a Green Card When Expired or Lost

Lawful permanent residents may receive temporary evidence of their lawful permanent resident status by mail rather than physically visiting a field office to receive an Alien Documentation, Identification and Telecommunication (ADIT) stamp (also known as an I-551 stamp).
 
Lawful permanent residents are entitled to evidence of status and may require temporary evidence of their status in the form of an ADIT stamp if:
  • They do not have their Green Card; or
  • Their Form I-90, Application to Replace Permanent Resident Card (Green Card), Form I-751, Petition to Remove Conditions on Residence, or Form N-400, Application for Naturalization, is still pending adjudication and their Green Card and extension notice have expired.
 
When lawful permanent residents call the USCIS Contact Center to request temporary evidence of status, an immigration services officer will verify their identity, their physical mailing address, and whether that address can receive UPS or FedEx express mail. They will then either schedule an in-person appointment for the lawful permanent resident, if needed, or submit a request to the USCIS field office to issue the ADIT stamp. If an in-person appointment is not needed, the USCIS field office will review the request for temporary evidence and mail the applicant a Form I-94 with ADIT stamp, DHS seal, and a printed photo of the lawful permanent resident obtained from USCIS systems.
 
USCIS may issue temporary evidence of status in the form of an ADIT stamp. USCIS determines if the requestor should receive an ADIT stamp and has the discretion to determine the validity period based on the lawful permanent resident’s situation (not to exceed one year, unless specified otherwise by regulation or policy).
 
Some lawful permanent residents will still need to appear in person at a USCIS field office to receive temporary evidence of their status, including those who have urgent needs, do not have a useable photo in USCIS systems, or whose address or identity cannot be confirmed.
 
The new process will allow USCIS to issue temporary evidence of lawful permanent resident status in a timely way without requiring a scheduled appointment at the field office, thereby reducing the burden on our applicants and increasing availability of field office resources.

If You File N-400 Naturalization Application After December 12 2023 Get 24 Months Green Card Extension

​Effective Dec. 12, 2022, U.S. Citizenship and Immigration Services (USCIS) is updating the USCIS Policy Manual to allow USCIS to automatically extend the validity of Permanent Resident Cards (commonly called Green Cards) for lawful permanent residents who have applied for naturalization for two years.
This update is expected to help naturalization applicants who experience longer processing times, because they will receive an extension of lawful permanent resident (LPR) status and may not need to file Form I-90, Application to Replace Permanent Resident Card (Green Card). LPRs who properly file Form N-400, Application for Naturalization, may receive this extension without regard to whether they filed Form I-90. USCIS will update the language on Form N-400 receipt notices to extend Green Cards for up to 24 months for these applicants. The receipt notice can be presented with the expired Green Card as evidence of continued status as well as identity and employment authorization under List A of Employment Eligibility Verification (Form I-9), if presented before the expiration of the 24-month extension period provided in the notice.

Prior to this change, under USCIS policy, naturalization applicants who did not apply for naturalization at least six months before their Green Card expiration date needed to file Form I-90, Application to Replace Permanent Resident Card (Green Card), to maintain proper documentation of their lawful status. Applicants who applied for naturalization at least six months prior to their Green Card expiration were eligible to receive an Alien Documentation, Identification, and Telecommunications (ADIT) stamp in their passport, which served as temporary evidence of their LPR status. This policy was based on the processing goal of 180 days or six months for Form N-400s, which would make filing Form I-90 unnecessary for applicants who filed at least six months before their Green Card expiration date. This policy update recognizes USCIS’ current processing times, while improving flexibility and efficiency by reducing the number of ADIT stamp appointments in field offices and the number of Form I-90s filed, which allows for these resources to be focused on other immigration benefit adjudications.

The extension will apply to all applicants who file Form N-400 on or after Dec. 12, 2022. LPRs who filed for naturalization prior to Dec. 12 will not receive a Form N-400 receipt notice with the extension. If their Green Card expires, they generally must still file Form I-90 or receive an ADIT stamp in their passport, in order to maintain valid evidence of their lawful permanent resident status. Lawful permanent residents who lose their Green Card generally must still file Form I-90, even if they have applied for naturalization and received the automatic extension under this updated policy. This is because noncitizens must carry within their personal possession proof of registration, such as the Green Card and any evidence of extensions or may be subject to criminal prosecution under INA 264(e). Applicants who require an ADIT stamp may request an appointment at a USCIS Field Office by contacting the USCIS Contact Center.

Если вы подаете заявление на гражданство США через натурализацию, форму N-400 после 12 декабря 2023, то вам выдадут Receipt Notice, I-797, письмо продляющее вашу грин карту на два года (24 месяца) с момента истечение.

How to Get a New Green Card If Lost or Stolen Abroad I-131A

Q: What can I do to get a new green card instead of the one lost or stolen abroad? How can I return to the United States if my green card was lost or stolen while traveling abroad?

A: This is a very stressful situation! You will need to pay the fee and apply for a document allowing you to return to the United States at the nearest US embassy.

The application form is I-131A has to be submitted in person at the U.S. embassy abroad. The government filing fee is U$575, payable online to USCIS prior to submitting the application. The application fee is non-refundable.  

If approved, the U.S. embassy will issue you a boarding foil, allowing you to board the flight back to the United States, and the USCIS will issue you a new green card once in the United States.

Anyone can pay the I-131A filing fee from anywhere in the world. Whoever pays the fee must use a credit or debit card or U.S. bank account.

The current filing fee is $575.00
You must submit your filing fee before going to a U.S. Embassy or U.S. Consulate to file your Form I-131A. You must bring evidence of payment with you when you appear in person at your nearest U.S. Embassy or U.S. Consulate to file Form I-131A.

Refund PolicyUSCIS does not refund fees, regardless of any action we take on your application, petition or request, or how long USCIS takes to reach a decision.

Information You May Need to Pay the Fee Online:
To pay the fee, you will need the correct first and last names, date of birth, and A-Number as they appear on the lawful permanent resident's (LPR's) Green Card or Reentry Permit.

USCIS Will Destroy Undeliverable Green Cards, Work Permits After 60 Days

NEWS from USCIS: Starting April 2, 2018, USCIS will destroy Permanent Resident Cards (Green Cards), Employment Authorization Cards (Work Permits) and Travel Documents returned to USCIS as undeliverable by the U.S. Postal Service after 60 business days, if USCIS is not contacted by the document’s intended recipient (applicant) to provide the correct address.

Update from USCIS: Начиная с 2 апреля 2018, USCIS будет уничтожать грин карты, разрешения на работу и на поездки за границу, если эти документы были возвращены в USCIS почтой как "недоставленные" (undeliverable), если заявитель не свяжется с USCIS, и не предоставит свой новый или правильный адрес в течение 60 дней после возврата документов почтой.

USCIS Started Accepting Credit Card Payments for Many Applications

​On February 14, 2018, USCIS announced that it will now accept credit card payments for filing most of its applications, including I-130, I-129F, I-485, I-765, I-131, I-601, I-90, N-400, N-600, etc.

Currently, credit card payment option is available for the 41 fee-based forms processed at USCIS Lockbox facilities. To pay by Visa, MasterCard, American Express or Discover, applicants will need to use USCIS Form G-1450. 


USCIS will enter credit card data into the Pay.gov system, operated by the U.S. Department of the Treasury, and will then destroy the Form G-1450 to protect the credit card information.

Applicants for naturalization, N-400, and applicants renewing or replacing their Green Cards, I-90, can already use a credit card if they file online at uscis.gov.

USCIS Alerts: Immigration Services Available to People Affected by Hurricane Harvey in Houston, TX

USCIS offers immigration services that may help people affected by unforeseen circumstances, including disasters such as Hurricane Harvey.

The following measures may be available on a case-by-case basis upon request:
  • Changing a nonimmigrant status or extending a nonimmigrant stay for an individual currently in the United States. Failure to apply for the extension or change before expiration of your authorized period of admission may be excused if the delay was due to extraordinary circumstances beyond your control;
  • Re-parole of individuals previously granted parole by USCIS;
  • Expedited processing of advance parole requests;
  • Expedited adjudication of requests for off-campus employment authorization for F-1 students experiencing severe economic hardship;
  • Expedited adjudication of employment authorization applications, where appropriate;
  • Consideration of fee waivers due to an inability to pay;
  • Assistance for those who received a Request for Evidence or a Notice of Intent to Deny but were unable to submit evidence or otherwise respond in a timely manner;
  • Assistance if you were unable to appear for a scheduled interview with USCIS;
  • Expedited replacement of lost or damaged immigration or travel documents issued by USCIS, such as a Permanent Resident Card (Green Card); and
  • Rescheduling a biometrics appointment.
Note: When making a request, please explain how the impact of Hurricane Harvey created a need for the requested relief.

What To Do If Your Green Card Lost, Stolen, Destroyed Abroad: New Form: I-131A Carrier Documentation

On September 30, 2016, USCIS has published Form I-131A, Application for Travel Document (Carrier Documentation), a new form that allows lawful permanent residents (LPRs) to apply for a travel document (carrier documentation) if they:
  • Are returning from temporary overseas travel of less than one year, and their Green Card has been lost, stolen or destroyed, or
  • Are returning from temporary overseas travel of less than two years, and their Reentry Permit has been lost, stolen or destroyed.
Note: The length of the absence will be measured from the time the LPR departed the U.S. to the time he or she pays the Form I-131A fee.
Applying for Carrier Documentation
To file Form I-131A, LPRs must pay the required fee online and then apply in person at a U.S. Embassy or Consulate.
The embassy or consulate will generally issue the carrier documentation within two weeks. The LPR should present the carrier documentation, which may be a boarding foil (similar to a visa) or transportation letter, to a transportation carrier instead of their Green Card or Reentry Permit.
The carrier documentation allows an LPR to prove to a transportation carrier only that they are authorized to travel to a United States port of entry to apply for admission to the United States. It is not a guarantee of admission or parole into the United States. CBP will conduct all required inspections when the LPR arrives at a United States port of entry and will make the final determination of whether to admit or parole the LPR to the United States.
Filing a Form I-131A does not give an LPR a new Green Card. To apply for a new Green Card, they must file Form I-90, Application to Replace Permanent Resident Card, and pay the filing fee. Visit our Form I-90 page at uscis.gov/I-90 for more information.
LPRs with Expired Green Cards
LPRs with expired Green Cards may not need to file Form I-131A. We encourage LPRs to check with their airline or vessel before determining whether to file Form I-131A.
Although regulations generally require an LPR to travel with a valid Green Card, CBP policy permits a transportation carrier bound for the United States to board an LPR  without carrier documentation if:
  • They have an expired Green Card that was issued with a 10-year expiration date, or
  • They have an expired Green Card with a 2-year expiration date AND a Form I-797, Notice of Action, showing that they have filed a Form I-751 or Form I-829 to remove the conditions on their permanent resident status. The Notice of Action extends the validity of the card for a specified length of time, generally one year.
Filing Fee
The filing fee for Form I-131A is $360. There is no biometric services fee. The fee for this form must be paid online using a credit or debit card or U.S. bank account through our online payment system.
Applicants cannot use a fee waiver for this form. As with all immigration fees, USCIS does not issue refunds, regardless of the decision on the application.
Because USCIS fees change periodically, please verify the current fee at uscis.gov/forms.
Where to File
Before appearing at a U.S. Embassy or U.S. Consulate to file Form I-131A, LPRs must submit the filing fee on the USCIS website. When appearing in person at a U.S. Embassy or U.S. Consulate to file Form I-131A, they must bring evidence that they paid the fee. Please contact the nearest U.S. Embassy or U.S. Consulate or visit its website to verify that they can process the Form I-131A and to read instructions on how to file.
